Taking a toll or maintaining a road, bridge, or ferry without authority

(1) Terms defined in Sections 76-1-101.5 and 76-8-101 apply to this section. (2) An actor commits taking a toll or maintaining a road, bridge, or ferry without authority if the actor, without authority: (a) demands or receives compensation for the use of a bridge or ferry; or (b) sets up or keeps a road, bridge, ferry, or constructed ford, for the purpose of receiving remuneration for the road's, bridge's, ferry's, or constructed ford's use. (3) A violation of Subsection (2) is a class B misdemeanor.
