(1) Terms defined in Sections 76-1-101.5 and 76-8-101 apply to this section. (2) An actor commits refusal to comply with an order to evacuate or order issued in a local or state emergency if the actor: (a) receives notice of: (i) an order to evacuate issued under Title 53, Chapter 2a, Emergency Management Act; or (ii) an order issued: (A) by the governor in a state of an emergency under Section 53-2a-204 ; or (B) by a chief executive officer in a local emergency under Section 53-2a-205 ; and (b) refuses to comply with the order described in Subsection (2)(a). (3) A violation of Subsection (2) is a class B misdemeanor.
