(1) (a) As used in this section: (i) "Board member" means an appointed member of the Board of Pardons and Parole. (ii) "Family member" means a parent, spouse, surviving spouse, child, or sibling of a judge or board member. (iii) "Judge" means: (A) a judge of a court of record; (B) a judge of a court not of record; or (C) a court commissioner. (b) Terms defined in Sections 76-1-101.5 and 76-8-101 apply to this section. (2) An actor commits threat with intent to impede, intimidate, interfere, or retaliate against a judge, board member, or family member if the actor threatens to assault, kidnap, or murder a judge, a board member, or a family member with the intent to impede, intimidate, or interfere with the judge or board member while engaged in the performance of the judge's or board member's official duties or with the intent to retaliate against the judge or board member on account of the performance of those official duties. (3) A violation of Subsection (2) is a third degree felony.
