Property damage or destruction by a trespasser on real property

(1) Terms defined in Sections 76-1-101.5 and 76-6-101 apply to this section. (2) An actor commits property damage or destruction by a trespasser on real property if, under circumstances not amounting to burglary as defined in Section 76-6-202 or 76-6-203 , the actor: (a) enters or remains unlawfully on real property; and (b) causes damage or pecuniary loss equal to or in excess of $1,500. (3) A violation of Subsection (2) is a second degree felony.
