declinations to prosecute. (1) Each prosecutorial agency within the state shall collect and submit the following data to the department: (a) the number of prosecutions during the previous calendar year in which charges were brought against an individual based on the individual's false accusation that a felony or misdemeanor had occurred; (b) the disposition of each prosecution described in Subsection (1)(a); and (c) the number of cases during the previous calendar year for which an alleged violation of any felony or misdemeanor was dismissed or declined: (i) based on evidence that no crime was committed or attempted; (ii) based on insufficient evidence to establish a likelihood of success at trial; or (iii) because the victim was unable to participate. (2) The information required by Subsection (1) shall be submitted to the department in the form and manner selected by the department. Renumbered and Amended by Chapter 291, 2026 General Session
