Prosecutorial data collection regarding certain prosecutions, dismissals, and

declinations to prosecute.
(1) Each prosecutorial agency within the state shall collect and submit the following data to the
department:
(a) the number of prosecutions during the previous calendar year in which charges were brought
against an individual based on the individual's false accusation that a felony or misdemeanor
had occurred;
(b) the disposition of each prosecution described in Subsection (1)(a); and
(c) the number of cases during the previous calendar year for which an alleged violation of any
felony or misdemeanor was dismissed or declined:
(i) based on evidence that no crime was committed or attempted;
(ii) based on insufficient evidence to establish a likelihood of success at trial; or
(iii) because the victim was unable to participate.
(2) The information required by Subsection (1) shall be submitted to the department in the form
and manner selected by the department.
