(1) As used in this section, "delegation of fire management authority" means the acceptance by the division of responsibility for: (a) managing a wildfire; and (b) wildfire costs and wildfire prevention costs as defined in Section 65A-8-217. (2) The division shall make rules, in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, governing the process for delegation of fire management authority. (3) Upon delegation of fire management authority, the division and its named designee becomes the primary incident commander. (4) The division may take action to recover costs described in Subsection (1)(b) upon delegation of fire management authority.
