Notification to and coordination with federal authorities. (1) As soon as practicable before the day of release, but at least five business days before the day of release, the department shall notify the United States Department of Homeland Security, or other relevant federal agency in charge of handling immigration violations or deportations, when the department is preparing to release an inmate who: (a) is being released after serving a term of imprisonment for a felony; and (b) is unlawfully present in the United States. (2) The department shall coordinate with federal authorities to transfer the custody of a released inmate into federal custody as may be required under Subsection (1).
