Each land use authorization shall contain terms and conditions that: (1) carry out the purposes of this chapter and rules issued under this chapter in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act; (2) minimize damage to scenic and esthetic values, fish and wildlife habitat, and otherwise protect the environment; (3) require compliance with applicable air and water quality standards established by applicable federal or state law; (4) require compliance with state standards for public health and safety, environmental protection, siting, construction, operation, and maintenance of or for rights-of-way for similar purposes if those standards are more stringent than applicable federal standards; and (5) are necessary to: (a) protect state property and economic interests; (b) efficiently manage the land that is subject to the land use authorization; and (c) protect the other lawful users of the lands adjacent to or traversed by the land that is subject to the land use authorization.
