Agency leave bank program

(1) Each agency shall establish and administer a leave bank program.
(2) Each agency shall ensure that the agency's leave bank program established in accordance with
this section:
(a) allows an employee to voluntarily donate the employee's paid time off to a centralized leave
bank administered by the agency; and
(b) directs the agency to distribute leave from the leave bank to an employee who satisfies the
agency's eligibility criteria.
(3) An employee may not donate sick leave to a leave bank established in accordance with this
section.
(4) The division shall create a model leave bank program policy that complies with this section and
make a copy of the model policy available to other agencies.
(5) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the division may
make rules governing leave bank programs described in this section.
