State preemption of local regulation

(1) Notwithstanding Title 17, Chapter 78, Part 6, Constables, or Section 10-7-87, a political
subdivision of this state may not enact any ordinance, adopt any resolution, or make any
policies relating to the licensing or regulation of constables.
(2) Any ordinance, resolution, or policy made by any political subdivision of this state relating to the
licensing, training, or regulation of constables is superseded by this chapter.
(3) This section does not prevent a contracting governmental entity from:
(a) including in a contract between a licensed constable and the contracting governmental entity
any provision that does not conflict with Subsection (1); or
(b) requiring a constable to conform with the contracting governmental entity's training, process,
standards, or other procedures when making an arrest or transporting a prisoner at the
direction and authorization of the contracting governmental entity.
