issue licenses. (1) Licenses under this chapter are issued in the classifications of: (a) constable; (b) deputy constable; and (c) apprentice constable. (2) An applicant for a license described in this chapter shall: (a) consent to, and complete, a criminal background check, described in Section 58-1-301.5; (b) meet any other standard related to the criminal background check described in Subsection (2)(a) that the division establishes by rule in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act; and (c) disclose any criminal history the division requests on a form the division approves. (3) (a) The division shall set initial licensing fees, renewal fees, and delinquency fees: (i) by license classification, as described in this section; (ii) in accordance with Section 63J-1-504; and (iii) in accordance with this section. (b) The division shall collect fingerprinting fees in accordance with Section 58-1-301.5. (4) A person may not: (a) act or assume to act as, or claim to be, a licensee unless the person is licensed under this chapter; or (b) falsely represent that the person is employed by a licensee. (5) The division shall, under the direction of the board, issue licenses to applicants who qualify for a license under this chapter. (6) A license issued under this chapter is not transferable or assignable.
