Investigation of a regulated activity

(1) The division shall be responsible for the investigation of a person or an activity that violates the
provisions of this chapter.
(2)
(a) The division shall investigate:
(i) a licensee alleged to engage in unlawful or unprofessional conduct; and
(ii) an unlicensed person engaged in a construction trade regulated under this chapter.
(3) If the division finds there is no apparent material jeopardy to the public health, safety, or
welfare, the division shall decline investigation of an alleged violation of this chapter.
(4)
(a) The division shall inspect construction trade to determine compliance with Subsections
58-1-501(2)(a)(vii), 58-55-601(14), and 58-55-602(2) through (4).
(b) Except for Subsection (4)(a), the division has no obligation to inspect construction trade to
determine compliance with applicable code or industry standard.
(5) An authorized representative of the division may enter the premises or a site to inspect work
regulated under this chapter for compliance.
