(1) An applicant for licensure as an instructor shall: (a) submit an application in a form prescribed by the division; (b) subject to Subsection (4), pay a fee determined by the division under Section 63J-1-504; (c) provide satisfactory documentation that the applicant is currently licensed or permitted in the discipline that the applicant is seeking to instruct; (d) provide satisfactory documentation that the applicant has completed six months of work experience in the discipline the applicant intends to instruct and: (i) an instructor training program for the discipline for which the applicant is licensed, by a licensed or recognized school for a minimum of 35% of the minimum hours for the license or permit the applicant intends to instruct; or (ii) on-the-job instructor training for the discipline for which the applicant is licensed, by a licensed or recognized school for a minimum of 35% of the minimum hours for the license or permit the applicant intends to instruct; and (e) meet the examination requirement established by administrative rules made by the division. (2) An applicant for an instructor license or permit under this chapter whose education in the discipline for which a license or permit is sought was completed at a foreign school may satisfy the educational requirement for licensure by demonstrating, to the satisfaction of the division, the educational equivalency of the foreign school education with a licensed school under this chapter. (3) (a) An individual may not instruct a discipline unless the individual has an instructor license that allows instruction of that discipline. (b) The division shall make rules establishing which disciplines each type of instructor license may instruct. (4) The division may not charge a fee to an individual applying for licensure as an instructor under this chapter if the individual is a licensed instructor in any other discipline under this chapter. (5) The division may offer any required examination under this section, which is prepared by a national testing organization, in languages in addition to English. (6) For purposes of a national accrediting agency recognized by the United States Department of Education, on-the-job instructor training described in this section is not considered a program.
