(1) To facilitate the on-time graduation from high school of a transferring student an LEA shall: (a) (i) waive specific courses required for graduation if similar coursework has been satisfactorily completed by the transferring student in a school in a sending state; or (ii) if the LEA does not waive a specific course requirement under Subsection (1)(a), provide an alternative means of acquiring the required coursework so that the transferring student may graduate on time; and (b) accept: (i) exit or end-of-course exams required for graduation from the transferring student's school in the sending state; (ii) national norm-referenced achievement tests; or (iii) subject to Subsection (2), alternative testing, in lieu of testing requirements for graduation. (2) If a transferring student is enrolling in a school in the LEA in the transferring student's senior year of high school and the LEA cannot accommodate the alternative testing described in Subsection (1)(b)(iii), the LEA shall, if the transferring student otherwise meets the graduation requirements of the transferring student's school in the sending state, use the LEA's best efforts to request and receive a receipt of a high school graduation diploma for the transferring student from the transferring student's school in the sending state. (3) If an LEA denies a waiver under Subsection (1)(a) the LEA shall provide a reasonable justification for the denial to the transferring student.
