Controlled-access highways -- Prohibiting use by class or type of traffic -- Traffic-

(1) A highway authority may regulate or prohibit the use of a controlled-access highway within
the highway authority's jurisdiction by any class or type of traffic that the highway authority
determines is incompatible with the normal and safe movement of traffic.
(2) For the safe movement of traffic during predicted or existing adverse weather conditions,
a highway authority may restrict traffic on a highway to vehicles with specific equipment or
capabilities.
(3) A highway authority shall erect and maintain traffic-control devices to inform the public of any
regulations, prohibitions, or restrictions implemented in accordance with this section.
(4) The Department of Transportation may make rules in accordance with Title 63G, Chapter 3,
Utah Administrative Rulemaking Act, to implement the provisions of this section, including:
(a) describing regulations or prohibitions on the use of a controlled-access highway in
accordance with Subsection (1); and
(b) describing what specific equipment or capabilities are required for vehicles during predicted or
existing adverse weather conditions in accordance with Subsection (2).
(5) For a highway within the jurisdiction of a county or municipal highway authority, the highway
authority may enact ordinances to implement provisions of this section, including:
(a) describing regulations or prohibitions on the use of a controlled-access highway in
accordance with Subsection (1); and
(b) describing what specific equipment or capabilities are required for vehicles during predicted or
existing adverse weather conditions in accordance with Subsection (2).
(6) When a highway authority has provided notice to the public through a traffic-control device in
accordance with Subsection (3), an individual is guilty of an infraction if:
(a) the individual fails to follow regulations or prohibitions on the use of a controlled-access
highway as described in Subsection (1); and
(b) the individual operates a vehicle without specific equipment or capabilities during predicted or
adverse weather conditions as described in Subsection (2).
