Electric mobility devices -- Law enforcement hold

(1) As used in this section:
(a) "Hold" means an action by a peace officer to take into custody and retain an individual's
personal electric device.
(b) "Personal electric vehicle" means the same as that term is defined in Section 41-6a-1512.
(c) "Release" means an action by a peace officer to transfer custody of an individual's personal
electric device to an individual.
(2) If a peace officer observes an individual under 18 years old commit a violation of this chapter
and the violation occurred while the individual was operating a personal electric vehicle, the
peace officer may hold the personal electric vehicle.
(3) If a peace officer holds an individual's personal electric vehicle as described in Subsection (2),
the peace officer may release the personal electric vehicle to only the individual's parent or
guardian.
