(1) With regard to information that constitutes a record under Title 63G, Chapter 2, Government Records Access and Management Act, notwithstanding that act, the department may not disclose a record, including analyses or a map, compiled or maintained pursuant to this part that is related to private lands and identify, or allow to be identified, the agricultural practices of a specific Utah landowner or producer. (2) In determining whether a record may be released, private interests are presumed to outweigh the public interest in disclosure. (3) Summary or aggregated data that does not specifically identify agricultural practices of an individual landowner or producer is not subject to this section.
