For any week beginning on or after January 1, 2020, the department may waive the one-week waiting period described in Subsection 35A-4-403(1)(d) and pay a benefit to an unemployed individual for that week if: (1) the unemployed individual otherwise qualifies for a benefit for that week; and (2) (a) the president of the United States has issued an order declaring a national emergency that is effective in the state during that week; (b) the governor has issued an executive order declaring a state of emergency as described in Title 53, Chapter 2a, Emergency Management Act, that is effective during that week; or (c) the federal government has agreed to reimburse the department for the cost of paying the benefit for that week.
