(1) The division shall require a nursing care facility that fails to pay an assessment due under this part to pay to the division, in addition to the assessment, a penalty determined by the division. (2) The department may waive the imposition of a penalty for good cause. (3) The division shall make rules in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, prescribing the administration and requirements for this section.
