As used in this chapter: (1) "Applicant" means an individual or entity that applies for a pipeline or other permit as described in this chapter. (2) (a) "Midstream facility" means a facility, structure, or infrastructure used for the gathering, processing, treatment, storage, or transportation of petroleum products between the point of extraction or production and the point of distribution or end use, including: (i) pipelines; (ii) storage tanks; (iii) processing plants; (iv) compression stations; (v) pumping stations; and (vi) related equipment and infrastructure necessary for the operation of the facility. (b) "Midstream facility" does not include: (i) a gathering line, flowline, or associated surface equipment subject to the regulation of the Board of Oil, Gas, and Mining; or (ii) an underground storage facility, including salt caverns and associated injection wells, regulated by the Board of Oil, Gas, and Mining under Title 40, Mines and Mining.
