17-22-33. Commissary account disclosure requirements. (1) As used in this section: (a) "Commissary account" means an account from which an inmate may withdraw money, deposited by the inmate or another individual, to purchase discretionary items for sale by a correctional facility. (b) "Commissary purchase" means a transaction initiated by an inmate by which the inmate obtains an item or items offered for sale by the correctional facility in exchange for money withdrawn from the inmate's commissary account. (c) "Correctional facility" means the same as that term is defined in Section 77-16b-102. (d) "Inmate" means an individual in the custody of a correctional facility for criminal charges or a criminal conviction. (2) A correctional facility that employs a policy or practice by which the correctional facility withdraws money from an inmate's commissary account, for any purpose other than a commissary purchase, must disclose that policy or practice to the inmate or any other individual seeking to make a deposit of money into the inmate's commissary account before the correctional facility may accept and deposit the money into the inmate's commissary account.
