Fiduciary capacity

A person soliciting, collecting, or expending a contribution for charitable purposes, and every
officer, director, trustee, or employee of a person concerned with the charitable solicitation,
collection, or expenditure of the contribution for charitable purposes, is a fiduciary and acts in a
fiduciary capacity.
