(1) As used in this section: (a) "Department" means the Department of Commerce. (b) "Property management" means the same as that term is defined in Section 61-2f-102. (2) Before August 31, 2026, the department shall make a recommendation to the Business and Labor Interim Committee regarding the jurisdiction of the Division of Consumer Protection and the Division of Real Estate over a person engaged in property management that: (a) identifies areas in which the jurisdiction of the Division of Consumer Protection and the Division of Real Estate overlap in relation to a person engaged in property management; (b) makes recommendations on whether to realign the jurisdiction of the Division of Consumer Protection or the Division of Real Estate to avoid duplicative jurisdiction over a person engaged in property management; and (c) identifies statutory changes to accomplish the recommendations described in Subsection (2) (b). (3) In developing the recommendation described in Subsection (2), the department shall consult with: (a) the Real Estate Commission; (b) the Division of Consumer Protection; (c) the Division of Real Estate; (d) one or more person engaged in property management; and (e) any other person the department determines has subject matter expertise to help develop the recommendation.
