Sec. 801.052. MEMBERSHIP ELIGIBILITY. (a) A person is eligible for appointment as a veterinarian member of the board if the person: (1) has resided and practiced veterinary medicine in this state for the six years preceding the date of appointment; (2) is of good repute; and (3) is not the holder of a special license issued under Section 801.256 . (b) A person is not eligible for appointment as a public member of the board if the person: (1) is licensed by an occupational regulatory agency in the field of health care; (2) is employed by or participates in the management of a business entity or other organization that: (A) provides health care services; (B) sells, manufactures, or distributes health care supplies or equipment; or (C) is regulated by or receives funds from the board; (3) owns or controls, directly or indirectly, more than a 10 percent interest in a business entity or other organization that: (A) provides health care services; (B) sells, manufactures, or distributes health care supplies or equipment; or (C) is regulated by or receives funds from the board; or (4) uses or receives a substantial amount of tangible goods, services, or funds from the board, other than compensation or reimbursement authorized by law for board membership, attendance, or expenses. (c) A person is not eligible for appointment as a public member of the board if the person's spouse: (1) is licensed by an occupational regulatory agency in the field of veterinary medicine; (2) is employed by or participates in the management of a business entity or other organization that: (A) provides veterinary health care services; (B) sells, manufactures, or distributes veterinary health care supplies or equipment; or (C) is regulated by or receives funds from the board; (3) owns or controls, directly or indirectly, more than a 10 percent interest in a business entity or other organization that: (A) provides veterinary health care services; (B) sells, manufactures, or distributes veterinary health care supplies or equipment; or (C) is regulated by or receives funds from the board; or (4) uses or receives a substantial amount of tangible goods, services, or funds from the board, other than compensation or reimbursement authorized by law for board membership, attendance, or expenses.
