Sec. 549.0453. RULES. (a) The executive commissioner shall adopt rules necessary for implementing the state prescription drug program. (b) In adopting rules for the state prescription drug program, the executive commissioner: (1) shall consult with an advisory panel composed of an equal number of physicians, pharmacists, and pharmacologists the executive commissioner appoints; and (2) may: (A) require an individual who is eligible for prescription drug benefits to pay a cost-sharing payment; (B) authorize the use of a prescription drug formulary to specify which prescription drugs the state prescription drug program will cover; (C) to the extent possible, require clinically appropriate prior authorization for prescription drug benefits in the same manner as prior authorization is required under the vendor drug program; and (D) establish a drug utilization review program to ensure the appropriate use of prescription drugs under the state prescription drug program.
