Sec. 541.261. NOTICE OF CLASS ACTION. (a) If an action is permitted as a class action under this subchapter, the court shall direct to the members of the class the best notice practicable under the circumstances, including individual notice to all members who can be identified through reasonable effort. (b) The notice must contain a statement that: (1) the court will exclude from the class a notified member if the member requests exclusion by a specified date; (2) the judgment, whether favorable or not, includes all members who do not request exclusion; and (3) a member who does not request exclusion may enter an appearance through counsel.
