Sec. 540.0274. PHARMACY BENEFIT PLAN: REBATES AND RECEIPT OF CONFIDENTIAL INFORMATION PROHIBITED. A Medicaid managed care organization, for purposes of the organization's outpatient pharmacy benefit plan required by Section 540.0273 in a contract to which this subchapter applies, may not: (1) negotiate or collect rebates associated with pharmacy products on the vendor drug program formulary; or (2) receive drug rebate or pricing information that is confidential under Subchapter D , Chapter 549 .
