Sec. 463.109. ASSOCIATION APPEARANCE BEFORE COURT; INTERVENTION. (a) The association may appear before a court in this state with jurisdiction over an impaired or insolvent insurer concerning which the association is or may become obligated under this chapter. The association's right to appear applies to: (1) a proposal for reinsuring, reissuing, modifying, or guaranteeing the insurer's policies or contracts; (2) the determination of the insurer's policies or contracts and contractual obligations; and (3) any other matter germane to the association's powers and duties. (b) The association may appear or intervene before a court in another state with jurisdiction over: (1) an impaired or insolvent insurer concerning which the association is or may become obligated; or (2) a third party against whom the association may have rights through subrogation of the insurer's policyholders or enrollees.
