Sec. 41.030. FINDINGS OF COMMISSIONER. On receiving the report of the returns of a referendum and election, the commissioner shall determine: (1) the number of votes cast for and against the referendum proposition; (2) the total volume of production of the commodity during the relevant production period in the area described in the petition; (3) the percentage of the total volume of production of the commodity that was produced by those voting in favor of the referendum proposition; and (4) the appropriate number of candidates receiving the highest number of votes for membership on the commodity producers board.
