Sec. 402.0235. PRIORITIES FOR COMPLAINT INVESTIGATIONS. (a) The division shall assign priorities to complaint investigations under this subtitle based on risk. In developing priorities under this section, the division shall develop a formal, risk-based complaint investigation system that considers: (1) the severity of the alleged violation; (2) whether the alleged violator showed continued or wilful noncompliance; and (3) whether a commissioner order has been violated. (b) The commissioner may develop additional risk-based criteria as determined necessary.
