Sec. 39.009. COMPLIANCE WITH CERTAIN CHAPTER REQUIREMENTS; LEGISLATIVE OVERSIGHT. (a) Failure to comply with a requirement of Subchapter B, C, or D: (1) does not prevent: (A) the administration of a statewide assessment instrument required under Subchapter B; or (B) the assignment of performance ratings under Section 39.054 ; and (2) may not be the basis of a challenge to: (A) a performance rating assigned under Section 39.054 ; or (B) an intervention or sanction imposed under this chapter or Chapter 39A . (b) Each standing legislative committee with primary jurisdiction over primary and secondary education shall establish a process to receive information regarding a failure to comply with a requirement of Subchapter B, C, or D and may require the agency to provide justification for that failure. The agency must notify each committee if the agency is aware that the commissioner or agency has failed to meet a deadline or other requirement under Subchapter B, C, or D.
