Sec. 36.208. PAYMENT TO QUALIFYING FACILITY. In establishing an electric utility's rates, the regulatory authority shall: (1) consider a payment made to a qualifying facility under an agreement certified under Subchapter C , Chapter 35 , to be a reasonable and necessary operating expense of the electric utility during the period for which the certification is effective; and (2) allow full, concurrent, and monthly recovery of the amount of the payment.
