Sec. 351.123. PETITION. (a) To create a district, a petition requesting creation of the district must be filed with the county clerk's office of each county in the proposed district. (b) Each petition must be signed by at least 10 percent of the registered voters in the county in which the petition is filed. (c) Each petition must be certified as valid by the county clerk of the county in which the petition is filed. On certification, the county clerk shall forward the petition to the commissioners court of that county. (d) A petition for creation of a district must include: (1) the name of the proposed district; (2) an accurate description of the area where the proposed district is to be located; (3) a statement of the purpose for which the district is to be created; and (4) a request that the district be created.
