Sec. 348.514. EXAMINATION; ACCESS TO RECORDS. (a) At the times the commissioner considers necessary, the commissioner or the commissioner's representative shall: (1) examine each place of business of each license holder; and (2) investigate the license holder's transactions and records, including books, accounts, papers, and correspondence, to the extent the transactions and records pertain to the business regulated under this chapter. (b) The license holder shall: (1) give the commissioner or the commissioner's representative free access to the license holder's office, place of business, files, safes, and vaults; and (2) allow the commissioner or the commissioner's representative to make a copy of an item that may be investigated under Subsection (a)(2). (c) During an examination or investigation the commissioner or the commissioner's representative may administer oaths and examine any person under oath on any subject pertinent to a matter that the commissioner is authorized or required to consider, investigate, or secure information about under this chapter. (d) All information relating to the examination or investigation process is confidential, including: (1) information obtained from the license holder; (2) the examination report; (3) instructions and attachments; and (4) correspondence between the license holder and the commissioner or the commissioner's representative relating to an examination or investigation of the license holder. (e) A license holder's violation of Subsection (b) is a ground for the suspension or revocation of the license. (f) An examination of a license holder's place of business may be made only: (1) after advance notice; and (2) during normal business hours.
