Sec. 33.2051. AGENCY RULEMAKING ACTIONS. (a) The land office shall comply with Sections 33.205 (a) and (b) when adopting or amending a rule governing the prevention of, response to, or remediation of a coastal oil spill. (b) The Texas Commission on Environmental Quality shall comply with Sections 33.205 (a) and (b) when adopting or amending a rule governing: (1) air pollutant emissions; (2) on-site sewage disposal systems; or (3) underground storage tanks. (c) The State Soil and Water Conservation Board shall comply with Sections 33.205 (a) and (b) when adopting or amending a rule governing agricultural or silvicultural nonpoint source pollution. (d) An agency shall comply with Sections 33.205 (a) and (b) when adopting or amending a rule governing an individual action described by Section 33.2053 . (e) The commissioner may not review a proposed rule of the Department of Agriculture.
