Sec. 31.058. RIGHTS OF PURCHASER OTHER THAN SECURED PARTY. (a) In this section, "buyer in ordinary course of business" has the meaning assigned by Section 1.201 , Business & Commerce Code. (b) A buyer in ordinary course of business has the protections afforded by Sections 2.403 (b) and 9.320 (a), Business & Commerce Code, regardless of whether: (1) an existing certificate of title was signed and delivered to the buyer; or (2) a new certificate of title listing the buyer as owner of record was issued. (c) Except as provided by Sections 31.053 and 31.0582 , the rights of a purchaser of a vessel or outboard motor that is not a buyer in ordinary course of business or a lien creditor are governed by the Business & Commerce Code.
