Sec. 304.251. ENFORCEMENT BY COMMISSION. (a) Except as provided by Section 304.253 , the commission shall receive and investigate complaints concerning violations of Subchapters B, C, and D and may impose an administrative penalty not to exceed $1,000 for each violation. (b) Notwithstanding Section 304.252 , if a complaint alleges that the person violating Subchapter B, C, or D is a telecommunications provider, as defined by Section 51.002 , Utilities Code, the commission has exclusive jurisdiction over the violation alleged in the complaint.
