Sec. 242.002. DEFINITIONS. In this chapter: (1) "Commission" means the Health and Human Services Commission. (2) "Commissioner" means the commissioner of aging and disability services. (3) "Controlling person" means a person who controls an institution or other person as described by Section 242.0021 . (4) "Department" means the Department of Aging and Disability Services. (5) "Elderly person" means an individual who is 65 years of age or older. (5-a) "Executive commissioner" means the executive commissioner of the Health and Human Services Commission. (6) "Facility" means an institution. (7) "Governmental unit" means the state or a political subdivision of the state, including a county or municipality. (8) "Home" means an institution. (9) "Hospital" has the meaning assigned by Chapter 241 (Texas Hospital Licensing Law). (10) "Institution" means an establishment that: (A) furnishes, in one or more facilities, food and shelter to four or more persons who are unrelated to the proprietor of the establishment; and (B) provides minor treatment under the direction and supervision of a physician licensed by the Texas Medical Board, or other services that meet some need beyond the basic provision of food, shelter, and laundry. (11) "Person" means an individual, firm, partnership, corporation, association, joint stock company, limited partnership, limited liability company, or any other legal entity and includes a legal successor of those entities. (12) "Resident" means an individual, including a patient, who resides in an institution. (13) "Retaliate" means an adverse action by the commission in response to a good faith action by a nursing facility responding to a commission decision negatively affecting the nursing facility.
