Sec. 173.051. CREATION OF DISTRICT. (a) A district may be created to provide commuter rail service between two municipalities: (1) each of which has a population of more than 450,000; and (2) that are located not farther than 100 miles apart as determined by the department. (b) The creating municipalities and the counties in which the creating municipalities are located may create a district on passage of a resolution favoring creation by the governing body of each municipality or county.
