Sec. 14.077. PENALTY FOR DEPOSITING GRAIN WITHOUT TITLE. (a) A person commits an offense if the person: (1) deposits grain without having title to the grain or deposits grain on which there is a lien or mortgage; (2) receives for the grain a negotiable receipt; and (3) negotiates the receipt for value with intent to deceive and without disclosing the person's lack of title or the existence of a lien or mortgage on the grain. (b) An offense under this section is a felony of the second degree.
