Sec. 112.202. ACTUAL KNOWLEDGE OR NOTICE OF AGREEMENT. (a) In this subchapter, a person or entity has "actual knowledge" of a community property survivorship agreement or the revocation of a community property survivorship agreement only if the person or entity has received: (1) written notice of the agreement or revocation; or (2) the original or a certified copy of the agreement or revoking instrument. (b) In this subchapter, a person or entity has "notice" of a community property survivorship agreement or the revocation of a community property survivorship agreement if: (1) the person or entity has actual knowledge of the agreement or revocation; or (2) with respect to real property, the agreement or revoking instrument is properly recorded in the county in which the real property is located.
