Sec. 1101.704. PENALTY TO BE PAID OR HEARING REQUESTED. (a) Not later than the 20th day after the date the person receives the notice under Section 1101.703 , the person may: (1) accept the executive director's determination, including the recommended administrative penalty; or (2) request in writing a hearing on the occurrence of the violation, the amount of the penalty, or both. (b) If the person accepts the executive director's determination, or fails to respond in a timely manner to the notice, the commission by order shall approve the determination and order payment of the recommended penalty or impose the recommended sanction.
