Sec. 11.0172. LIMIT ON CONTRACTS FOR PUBLICATIONS. (a) In this section: (1) "Publication" includes the publication of a book, magazine, photograph, poster, or bulletin. (2) "Youth" means an individual younger than 17 years of age. (b) The department may not contract with a person regarding a publication unless the contract provides the department the authority to: (1) terminate the contract for a violation of a rule adopted under Subsection (c); (2) retain final approval over the content of the publication, including advertising; and (3) request and receive an appropriate number of copies of the publication that contain advertising that is appropriate for viewing by youth. (c) The commission shall adopt rules regarding the types of advertising that are appropriate for viewing by youth.
