Sec. 1063.302. VALIDITY OF PETITION FOR ELECTION. (a) Not later than the 30th day after the date a petition requesting the dissolution of the district is submitted under Section 1063.301 , the Montgomery County elections administrator shall: (1) determine whether the petition is valid; and (2) certify the determination of the petition's validity to the board. (b) If the elections administrator fails to act within the time allowed, the petition is treated as if it had been found valid. (c) If a petition submitted under Section 1063.301 does not contain the necessary number of valid signatures, the district residents may not submit another petition under Section 1063.301 before the third anniversary of the date the invalid petition was submitted. (d) The district shall reimburse the county elections administrator for reasonable costs incurred in performing the duties required by this section.
