Sec. 1001.255. REGULATION OF CERTAIN DRIVER EDUCATION INSTRUCTORS. (a) The department shall regulate as a driver education provider of the type determined appropriate by the department a driver education instructor who: (1) teaches driver education courses in a county having a population of 50,000 or less; and (2) does not teach more than 200 students annually. (b) An instructor described by Subsection (a) must submit to the department an application for an initial or renewal driver education provider license, together with all required documentation and information. (c) The executive director may waive initial or renewal driver education provider license fees. (d) An instructor described by Subsection (a) is not exempt from a licensing requirement or fee.
