In deciding whether or not to grant a certificate of approval, the commissioner shall take into account all pertinent facts, data, and conditions relative to the proposed action, but shall not grant any certificate unless the following conditions have been met: (1) The commissioner determines that the proposed action will be conducted in such a way that the safety of the public is adequately provided for; (2) All information requested by the commissioner relative to the proposed action has been provided; and (3) All fees required by this chapter have been paid.
