(a) This chapter creates mental health treatment court programs within the state that follows the general principles referenced in § 16-19-107 and that is approved by the department of mental health and substance abuse and established by the judge of a court in this state exercising criminal jurisdiction. (b) This chapter does not confer a right or an expectation of a right to treatment for an offender within the criminal justice system. (c) A recovery court program, including but not limited to, a veterans treatment court program or a drug court treatment program, shall operate separate and apart from a mental health treatment court program.
