South Dakota Code § 9-14-3

Municipality to determine duties of officers--Appointment of officers--Terms--No property interest in employment--Exception

Each municipality may determine, by ordinance, which officers are to be appointed and describe the duties of each appointed officer.
Except as provided in chapter
9-10
:
(1) In municipalities governed by a mayor and common council, each appointed officer is appointed by the mayor, with the approval of a majority vote of all the members of the common council qualified to serve pursuant to chapter
9-13
; and
(2) In municipalities that are not governed by a mayor and common council, each appointed officer is appointed by a majority vote of all of the members qualified to serve on the governing body pursuant to chapter
9-13
.
Each appointed officer may be appointed annually or at intervals determined by the governing body. Except where a property interest arises by written contract, the appointment does not confer any property interest in employment.
