South Dakota Code § 55-4-33

Violations of chapter--Removal--Liability--Compensation until court ceases

If a trustee violates any of the provisions of this chapter, the trustee may be removed and denied compensation in whole or in part, and any beneficiary, cotrustee, or successor trustee may treat the violation as a breach of trust. Until the cessation of compensation is ordered by a court, a trustee is entitled to fees and expenses.
