Maintenance of drains--Assessment of costs

Any drain that has been constructed under the provisions of this chapter or chapter
46A-11
is under control of the board or commission and shall be kept open and in repair by it, unless otherwise provided. If any drain is situated in more than one county, care of the portion lying within each county is assigned to that county's board or commission to be kept open and in repair. The cost of repairs shall be assessed, levied, and collected in the same manner as provided in this chapter and chapter
46A-11
for construction of drains.
